RAYBURN: Careful consideration has been given to the bill (H. R. 2779) transmitted with your letter of January 7, 1935, with request for a report thereon and such views relative thereto as the Department might desire to communicate. This bill would extend for 1 and 3 years, respectively, from May 12, 1934, the times for commencing and completing the construction of a bridge across the Waccamaw River at Conway, S. C., authorized to be built by the county of Horry, S. C. This Department fails to find any act of Congress authorizing the construction of such a bridge by Horry County, S. C. However, there was an act approved February 10, 1932 (47 Stat. 42), authorizing the highway department of South Carolina to construct, maintain, and operate a free highway bridge, and approaches thereto, across the Waccamaw River near Conway, and the times for commencing and completing this bridge were extended 1 and 3 years, respectively, by the act approved May 12, 1933 (48 Stat. 55). This latter act is perhaps the one intended to be referred to in the pending bill and the proposed extension of time is without objection so far as this Department is concerned. Sincerely, H. A. This bill would legalize the reconstruction of what is known as the "Union Street Bridge" across the Dan River at Danville, Va. The reconstruction of this bridge was submitted by the State Highway Department of Virginia as Federalaid highway project no. 320-C and such project was approved by this Department and an agreement entered into for its construction with funds apportioned to the State under section 204 of the National Industrial Recovery Act. The accompanying bill, S. 1342, Seventy-fourth Congress, first session, proposes to extend the times for commencing and completing the construction of a bridge across the Mississippi River at or near the road between the villages of Cohasset and Deer River, Minn. Authority for the construction of the bridge in question was granted by act of Congress approved May 1, 1928, subject to the terms of the general bridge law, section 6 of which provides that the authority granted shall cease and be null and void unless the actual construction of the bridge be commenced within 1 year and completed within 3 years from the date of approval of the special act. So far as known to the War Department no advantage was taken of the authority granted, and pursuant to the restrictions imposed by the general bridge law, as above stated, the franchise expired by limitation on May 1, 1931, in view of which it would seem preferable to amend the bill now under consideration so as to revive and reenact the original law, rather than to resort to the necessity of duplicating the act of May 1, 1928. The bill, herewith, has been amended accordingly and as thus amended, I know of no objection to its favorable consideration by Congress. GEO. H. DERN, Secretary of War. |
