Viaduct in line of Benning Road: The committee recommends that the following proviso requiring the railroad companies to pay one-half the cost, be stricken from the bill: "Provided, That one-half of the total cost thereof shall be borne and paid by the said railroad companies, their successors and assigns, to the collector of taxes of the District of Columbia, to the credit of the District of Columbia, and the same shall be a valid and subsisting lien against the franchises and property of the said railroad companies, and shall constitute a legal indebtedness of said companies in favor of the District of Columbia, and the said lien may be enforced in the name of the District of Columbia by a bill in equity brought by the said Commissioners in the Supreme Court of the District of Columbia, or by any other lawful proceeding against the said railroad companies;"

The committee recommends that the following paragraph concerning the payment of tuition by nonresident pupils be stricken from the bill:

No part of the appropriations herein made for the public schools of the District of Columbia shall be used for the free instruction of pupils who dwell outside the District of Columbia: Provided, That this limitation shall not apply to pupils who are enrolled in the schools of the District of Columbia on the date of the approval of this Act.

And the following paragraph inserted:

The children of officers and men of the United States Army, Navy, and Marine Corps, and children of other employees of the United States stationed outside the District of Columbia shall be admitted to the public schools without payment of tuition.

TO AUTHORIZE THE SECRETARY OF THE NAVY TO PROCEED WITH THE CONSTRUCTION OF CERTAIN PUBLIC WORKS, AND FOR OTHER PURPOSES

[To accompany H. R. 5576]

The Committee on Naval Affairs of the Senate, to whom was referred the bill (H. R. 5576) to authorize the Secretary of the Navy to proceed with certain public works, and for other purposes, having considered the same, report it to the Senate with the recommendation that the bill do pass. H. R. 5576 is a companion bill of S. 1838, both being department bills.

The purpose of the bill is to authorize the Secretary of the Navy to proceed with the construction of certain public-works projects at the various naval shore establishments at a cost not to exceed the amount stated for each item in this bill. This bill is simply an authorization bill, which authorizes future appropriations for the projects named, and does not appropriate any money.

In view of the fact that both the House and Senate Committee on Naval Affairs held hearings on this bill and as H. R. 5576 has already passed the House and has been referred to this committee, it is reported out without amendment. As an explanation and description of the need for each item of improvement contained in the bill and the reasons for recommending the acquisition of certain land is given in House Report No. 261, it is hereby made a part of this report.

The limit of cost of the above items is $38,098,000.

The bill has the recommendation of the Navy Department.
