Blister-rust control and Dutch elm-disease eradication: The committee is of the opinion that more funds should be appropriated for investigation and control of the Dutch elm disease and blister rust, but in view of the fact that appropriations contained in the Emergency Relief Appropriation Act of 1935 will be available for allocation for these purposes, it has not increased the amounts carried in the bill for these purposes. It does feel, however, that sufficient funds should be allocated from relief appropriations to carry on these important control projects and have faith in believing it will be done.

For emergency construction of public highways and other related projects in accordance with section 1 of the Act entitled "An Act to increase employment by authorizing an appropriation to provide for emergency construction of public highways and related projects, and to amend the Federal Aid Road Act, approved July 11, 1916, as amended and supplemented, and for other purposes' approved June 18, 1934 (48 Stat. 993), the sum of $100,000,000 (being the remainder of the amount of $200,000,000 authorized to be appropriated by section I of such Act) shall be made immediately available for the foregoing purposes from the appropriation in section 1 of the Emergency Relief Appropriation Act of 1935 and continue available until expended.

The committee recommend the following concerning forest roads and trails:

That the Secretary of Agriculture shall, upon the approval of this Act, apportion and prorate among the several States, Alaska, and Puerto Rico, as provided in section 23 of said Federal Highway Act, the sum of $10,000,000 authorized to be appropriated for the fiscal year ending June 30, 1936, by the Act approved June 18, 1934: Provided further, That the Secretary of Agriculture shall incur obligations, approve projects, or enter into contracts under his apportionment and prorating of this authorization, and his action in so doing shall be deemed a contractual obligation on the part of the Federal Government for the payment of the cost thereof: Provided further, That total expenditures on account of any State or Territory shall at no time exceed its authorized apportionment: Provided further,

The Committee recommend the following new section to the bill:

SEC. 2. No part of any appropriation contained in this act shall be used for the payment of personal services or for the maintenance of any activity not specifically authorized by law.

The Committee on Commerce, to whom was referred the bill (S. 1994) to amend the Inland Waterways Corporation Act, approved June 3, 1924, as amended, having considered the same, report favorably thereon, and recommend that the bill do pass without amendment.

The bill has the approval of the War Department, as will appear by the annexed communication.

MY DEAR SENATOR: In response to your request of February 27, 1935, for suggestions re S. 1994, to amend the Inland Waterways Corporation Act, approved June 3, 1924, as amended, the effect of the passage of this bill would be to make subdivision (e) of section 3 of the act entitled "An act to create the Inland Waterways Corporation for the purpose of carrying out the mandate and purpose of Congress, as expressed in sections 201 and 500 of the Transportation Act, and for other purposes", as amended, read as follows (the amendment being shown in capitals, and the original being shown with dashes through the text): "(e) Any person, firm, or corporation, including the Inland Waterways Corporation, engaged or about to engage in conducting a common carrier service upon the Warrior, Mississippi, Columbia, (er Snake Rivers) SNAKE, SACRAMENTO, or SAN JOAQUIN RIVERS, or any tributaries thereof, may apply to the Interstate Commerce Commission and obtain a certificate of public convenience and necessity in accordance with the provisions of section 1 of the Interstate Commerce Act, as amended. * * *",

There is no other change contemplated and this bill simply provides for the same action upon an application for a certificate of public convenience and necessity when submitted by carriers upon the Sacramento or San Joaquin Rivers, as is now provided for in the case of carriers upon the Warrior, Mississippi, Columbia, or Snake Rivers and their tributaries. This Department sees no objection to this amendment.

Mr. COPELAND, from the Committee on Commerce, submitted the

REPORT

[To accompany S. J. Res. 93]

The Committee on Commerce, to whom was referred the joint resolution (S. J. Res. 93) to extend the time within which contracts may be modified or canceled under the provisions of section 5 of the Independent Offices Appropriation Act, 1934, having considered the same, report favorably thereon, and recommend that the bill do pass without amendment.

The purpose of this resolution is to give a reasonable time to prepare and present a bill to carry out the President's recommendations regarding shipping subsidies. The matter is so complicated that it is doubtful if the committees of the two Houses will be able before the 30th of April, the date of expiration fixed by the Independent Offices Act of 1934, to do this.

It is expected that such legislation will be prepared and ready for the consideration of Congress within a few weeks. It is hoped by the Committee on Commerce of the Senate that final action upon the subsidy measure shall be enacted during this session. The sole purpose of the resolution is to give reasonable time for these purposes, and not to require the impossible, as certainly would be the case if legislation were demanded previous to the 30th of April.
