CONTRACTUAL NEGOTIATIONS-FISCAL YEAR 1985 NEW STARTS

Chairman HATFIELD. Update the Committee on the Corps activities and progress related to negotiation of binding cost sharing agreements with non-Federal interests as provided in the 1985 Supplemental. Have non-Federal interests been eager to come forward and sign formal binding contracts?

Mr. DAWSON. One sponsor has signed an agreement; this was a standard 221 agreement which was previously executed under traditional cost-sharing.

It is very likely that Local Cooperation Agreements on an additional 12 projects will be signed by June 30, 1986. Of the remaining projects, 6 do not require Local Cooperation Agreements, 9 are likely to have a Local Cooperation Agreement signed by June 30, 1986, 10 are possible, and 4 do not appear likely. I have a table summarizing the current status of these projects that I would like to provide for the record. [The information follows:]

SCOPE OF PROJECT Phased construction: Scheduled 57 foot entrance channel, 55 foot Bay Channel and 40 foot McDuffie Island Turning Basin. Transshipment Facility (constructed by sponsor). Remainder of project unscheduled.

Non-Federal portion will be financed by revenues from dock operations, oil-lease funds, industrial development bonds, and state appropriated funds. Construction period to be phased to be phased to match Alabama State Docks requirements. Incremental maintenance dredging cost sharing must be determined.

Breakwater, entrance channel, anchorage area.

Remarks Possible problem on timing of availability of sponsor's funds. Portion of funding would be subject to state-wide referendum scheduled for November 86. Initiation of construction is contingent upon passage of referendum.
