Whereas it is certified unto me by the deputy clerk of affize of the home circuit, That at the affizes held at C. in and for the county of S. on Monday, ant, after the third day of Auguft, in the fortyfirst year of his prefent majesty's reign, before the right honorable L. lord K. lord chief juftice of our faid lord the king, and the honorable fir N. G. knight, one of the juftices of our faid lord the king, justices affigned to hold pleas before the king himself, R. C. late of the parish of K. upon T. in the county of S. gentleman, was in due form of law tried and convicted upon a certain indictment then and there depending against him and feveral others for certain affaults, riots, and mifdemeanors, committed on the fourth day of April laft, at the faid parish of K. upon T. in the county aforefaid.

These are therefore to will and require, and in his majefty's name ftrictly to charge and command you, and every of you, on fight hereof, to apprehend and take the body of the faid R. C. and bring him before me, or one other of the judges of his majefty's court of King's Bench, if taken in or near the cities of L. or W. if elsewhere, before fome justice of the peace near to the place where he shall be herewith taken; to the end that he may become bound with fufficient fureties for his perfonal appearance in his majesty's court of King's Bench at W. on the fifth day of the next Michaelmas term, in order to receive the judg ment of the faid court for the faid offence, and to be fur.

Take notice that this honorable court will be moved on Tuesday, the fixth day of May, instant, or so soon after as counsel can be heard, that you the faid defendant S. H. may be called to appear and receive the judgment of the faid court upon the indictment whereof you ftand convicted, and in cafe you the faid defendant do not appear, the faid court will then be moved that fuch default may be recorded, and that the recognizance entered into by you I. K. of [&c.] and L. M. of [&c.] for the perfonal appearance of you the faid defendant in this court may be eftreatedt into his ma jefty's court of Exchequer. Dated the first day of May, 1802.

Be it remembered that at the general quarter feffions of the peace of our lord the king, holden in and for the county of M. at the feffion house for the faid county, on Monday the fifth day of July, in the twentyfourth year of the reign of our fovereign lord George the third, king of Great Britain, &c. before W. enquire for our fovereign lord the king, for the body of the fame county, it is prefented in manner and form following, that is to fay, M. The jurors for our lord the king (Indictment upon their oath prefent that R. E. late of the parish of E. B. in the county of M. labourer, not having the fear of God before his eyes, but being moved and feduced by the inftigation of the devil, on the eighteenth day of June, in the twenty-fourth year of the reign of our fovereign lord George the third, king of Great Britain, &c. with force and arms, at the parish aforefaid, in the county aforesaid, in and upon W. P. L. R. in the peace of God, and our faid lord the king, then and there being, feloniously, wilfully, and of his malice aforethought, did make an affault, and that the faid R. E. a certain pistol of the value of five fhillings, then and there charged with gunpowder, and one leaden bullet; which faid piftol he the faid R. E. in his right hand then and there had and held, then and there feloniously

felonioufly, wilfully and of his malice aforethought did dif. charge and fhoot off to, againft and upon the faid W. P. L. R. and that the faid R. E. with the leaden bullet aforefaid, and of the piftol aforefaid, then and there by the force of the gunpowder aforefaid, by the faid R. E. difcharged and fhot as aforefaid, then and there feloniously, wilfully, and of his malice aforethought, did itrike, penetrate, and wound the faid W. P. L. R. in and upon the right fide of the belly of him, the faid W. P. L. R. near the right hip of him, the said W. P. L. R. giving to him the said W. P. L. R. then and there with the leaden bullet aforefaid, fo as aforefaid difcharged and fhot out of the piftol aforefaid, by force of the gunpowder aforefaid, by the faid R. E. in and upon the right fide of the belly of him the faid W. P. L. R. near the faid right hip of him the faid W. P. L. R. one mortal wound of the depth of four inches, and of the breadth of half an inch, of which faid mortal wound, he the faid W. P. L. R. then and there inftantly died; and fo the jurors aforefaid, upon their oath aforefaid, do fay that the faid R. E. then and there feloniously, wilfully, and of his malice aforethought did kill and murder him the faid W. P. L. R. in manner and form aforefaid, against the peace of our faid lord the king, his crown and dignity. Wherefore the fheriff of the faid county of M. is commanded that he do not omit by reason of any liberty in his bailiwick, but that he take the faid R. E. if he fhall be found in his bailiwick, and him fafely keep, fo that he may have his body before the juftices of our faid lord the king, affigned to keep the peace in the county aforefaid, and alfo to hear and determine divers felonies, trefpaffes, and other misdemeanors committed in the fame county, at the next general feffion of the peace to be holden for the county aforefaid, to answer our faid lord the king concerning the faid felony and murder whereof he is indicted as above fpecified. At which faid next general ance to the feffion of the peace, to wit, at the general feffion of the on a fuggeftion that the fheriff did not return the writ.)

E. if he fhall be found in his bailiwick, and bim fafely keep, so that he may have his body before the justices of our faid lord the king, affigned in form aforefaid, at the next general quartér feffion of the peace to be holden for the faid county, to anfwer our faid lord the king, concerning the faid felony and murder whereof he is indicted as above fpecified; at which faid next general quarter feffion of the peace, to wit, at the general quarter feffion of the peace of our lord the king, holden for the county of M. at the guild-hall in King-Street, W. in the faid county, on Thursday, in the week next after the feaft of St. Michael, to wit, the feventh day of October, in the twenty-fourth year of the reign of our fovereign lord George the third, king of Great Britain, &c. before W. M. C. S. J. L. T. G. efquires, and others their fellows, juftices of our faid lord the king, affigned to keep the peace in the county aforefaid, and alfo to hear and determine divers felonies trefpaffes, and other mifdemeanors, committed in the fame county, and the sheriff of the faid county of M. doth not return the writ in this behalf to him directed, to the said justices
