By letter dated July 15, 1987, the Honorable Peter W. Rodino, Chairman of the House Committee on the Judiciary, requested that the United States District Court for the Southern District of Florida make available to the Committee for inspection and copying the records of the grand jury, No. 81-1GJ (MIA) which returned an indictment against Judge Hastings.

I am enclosing herewith for the Court's consideration a Proposed Order granting the Committee's request. We would ask that the Court consider this request at your earliest convenience. In addition to our desire to begin immediately our review of the grand jury materials, we believe such an Order will expedite our interviews of government employees on subjects relating to grand jury materials and information derived therefrom.

With respect to the problem of locating the original grand jury materials, as discussed in your letter of July 29, 1987 to Chairman Rodino, the Committee has not received either the original or copies of the grand jury proceedings from the Investigating Committee. We have so advised Mr. Burchill. However, for the purpose of the Committee's immediate needs, inspection and copying of the copy in the possession of either Mr. Doar or Mr. Reid Weingarten of the Public Integrity Division of the Department of Justice will be sufficient for the time being. Accordingly, we would respectfully request that

consideration of the Proposed Order not await resolution of this

issue.

This letter will confirm that the Committee on the Judiciary, United States House of Representatives has agreed with counsel for Judge Hastings, Terence J. Anderson, not to seek or accept from any source the grand jury materials covered by Order No. 87-1, entered by this Court on August 5, 1987, pending the decision by the United States District Court for the Southern District of Florida on Judge Hastings' Emergency Motion to Stay and Unseal Miscellaneous Order No. 87-1. In Assistant Counsel Robert B. Levin's telephone conversation with Mr. Anderson on August 12, 1987, it was also agreed that the Committee's forbearance in this regard is without prejudice to its request for the grand jury materials. It is our understanding that the Court intends to set Judge Hastings' motion for hearing late next week, probably on Friday, August 21, 1987.

We will await confirmation of the hearing date.

ORDER OF RECUSAL AND REQUEST FOR
DESIGNATION

The Committee on the Judiciary of the United States House of Representatives, the Honorable Peter W. Rodino, Jr., Chairman, on July 15, 1987, reqested "---delivery to the Subcommittee all of the records, transcripts, minutes and exhibits of Grand Jury 81-1-GJ (MIA) which indicted Judge Hastings in Case No.

81-598-Cr." The Judge Hastings referred to in the request is the Honorable Alcee L. Hastings, United States District Judge for the Southern District of Florida.

On the 5th day of August 1987, the undersigned entered Misc. Order No. 87-1, granting the request and causing a copy of the order to be served upon counsel for Judge Hastings.

Upon receipt

of the order of August 5, 1987, Terence J. Anderson, Esq. counsel for Judge Hastings, notified the court that he wished to file an emergency motion to stay the order authorizing the release of the materials to the Congressional Committee. This emergency motion was filed on August 10, 1987, together with a request for a hearing thereon.

The court was subsequently advised, on August 11, 1987, that Special Counsel to the Judiciary Committee, Alan I. Baron, and counsel to Judge Hastings, Terence J. Anderson, had agreed to a
